The Ruling on Delaying Ihram in Jeddah: Must Pilgrims Return to the Miqat?

Question to Shaykh Ibn Baaz:


Some people arriving from outside the Kingdom of Saudi Arabia, when they reach Jeddah, are told: “Stay for three days in Jeddah, then enter into iḥrām from the miqāt.” What is the ruling on this?



Shaykh Ibn Baz Answer:


They are required to return to their miqāt (prescribed station for entering iḥrām) if they came intending ḥajj or ʿumrah. It is not permissible for them to pass the miqāt without entering into iḥrām, because the Messenger ﷺ, when he designated the mawāqīt (fixed places) for the people of Madīnah, Shām, Najd, Yemen, and others, said:


“These are for them and for anyone who comes to them from other than their people, intending ḥajj or ʿumrah.”
(Narrated by al-Bukhārī no. 1526 and Muslim no. 1181)

So they must enter into iḥrām at the miqāt they pass if they are intending to perform ḥajj or ʿumrah.


If they pass it without entering into iḥrām, they must go back to it and enter into iḥrām from there. But if they passed it, did not return, and entered iḥrām after it, then they must offer a sacrifice (dam) as expiation.


Likewise, if they are unable to return to the miqāt, then they should enter iḥrām from where they are, and still, a sacrificial animal (dam) is due upon them. It must be an animal suitable for udḥiyah, slaughtered in Makkah for the poor, and distributed among them.
