Ruling on Tamattu for One Who Performs Umrah in Dhul Qadah and Then Leaves Makkah Before Hajj

Question to Shaykh Ibn Baaz:


If a person performs ʿUmrah during the months of Ḥajj (specifically in Dhul-Qaʿdah), then leaves Makkah and travels to Madīnah to stay there until the time of Ḥajj, is he then required to perform Ḥajj as a mutamattiʿ, or is he free to choose the type of Ḥajj he intends? Please advise, may Allah reward you.



Shaykh Ibn Baz Answer:


The correct view is that the Muslim remains under the ruling of a mutamattiʿ (i.e., one performing tamattuʿ Ḥajj) if he performs ʿUmrah during the months of Ḥajj, then travels to Madīnah for visitation and later returns in the state of iḥrām for Ḥajj. In this case, he is most likely considered a mutamattiʿ and thus required to offer the hady (sacrificial animal) for tamattuʿ.


Likewise, if he goes to al-Ṭāʾif or Jeddah or any other place besides his homeland, and then returns in the state of iḥrām for Ḥajj, then he is also most likely considered a mutamattiʿ.


However, if he returns to his hometown, stays with his family, and then comes back in iḥrām for Ḥajj, then he is most likely considered under the ruling of someone performing ifrād (Ḥajj only), and thus not considered a mutamattiʿ. In this case, he is not required to offer the hady, as reported from Ibn ʿUmar and his father (may Allah be pleased with them both), and this is the view of the scholars. [1]
